Although Chinese speculative investors have anticipated registration in certain cases, registering Chilean trademarks which have not been registered by retailers, local companies have been active in the registration process of their ‘flags’ in such market. According to the information of the World Intellectual Property Organization (WIPO), between the years of 2002 and 2013, Chilean nationals have registered 984 trademarks in the Asian country, while the registration of 1,673 additional flags has been requested. Registrations have been completed especially during the last few years.

“Based on information supplied by WIPO, between the years of 2002 and 2013, (excluding Macao and Hong Kong) more than 400 Chilean trademarks were registered in China, and applications for 762 new trademarks were filed”, contends the National Institute of Intellectual Property. They add that, for these purposes, applications or registrations of Chilean trademarks are deemed to be those in which applicants have declared to the Chinese body, upon submission of their application, a domicile or residence in our country, and not the domicile of their branch in that market. 

 

In view of this information, Chile is the third country of the region with the highest number of trademarks registered in China. According to the WIPO, Mexico leads this ranking with 2,382 trademarks, followed by Brazil with 1,956 and then Chile. In the fourth place is Argentina with 809 and far below is Peru with 181.
