Patent Prosecution Highway (PPH) – Pilot Program between Brazil and France is signed

The Brazilian Patent and Trademark Office (BRPTO) informed on March 15, 2022, that two memoranda of understanding – one for technical cooperation in Industrial Property and the other for a Patent Prosecution Highway (PPH) pilot project- between Brazil and France were signed.

This partnership in the PPH program is planned for a period of five years and should start on May 1st, 2022.

It is important to emphasize that, through the PPH, participants will be able to use the result of the examination of the patent application at the BRPTO to speed up the analysis in France and they can also use the result of the examination in France to speed up the analysis at the BRPTO, for patent cases claiming a French priority.

Finally, the PPH program has signed agreements with the following countries/regions:

a) the United States

b) European Patent Office

c) Japan

d) China

e) Austria

f) Sweden

g) the United Kingdom

h) Denmark

i) South Korea

j) Singapore

k) Portugal.
