Why can the right of industrial design protection terminate?

Nullity: Industrial designs are null and void in the following cases:

  • They are not novel or unique
  • The applicant is not legitimated to be the holder
  • The design applied for is incompatible with a design which is already registered in that country
  • It uses emblems, distinctive marks etc. of a country.
  • It includes a trade mark or other distinctive sign •Unauthorised use of a work protected by copyright. Expiry: Expiry of the designs means that they enter the public domain. The reasons for this are:
  • For not having been renewed at the end of the five-year period
  • If the holder waives the design
  • Because the holder no longer meets the legitimisation conditions in order to be holder
